Creator Program Terms

Plain English. Read this before joining the program.

Heads up

These terms are in addition to the regular OrderFit Terms of Use and Privacy Policy. Where they conflict, these creator-program terms control for things specific to the program (payouts, leaderboards, etc.).

1. Who can join

To participate in the OrderFit Creator Program ("Program") you must be at least 18 years old, legally able to enter into a contract in your jurisdiction, and not located in a country subject to a comprehensive U.S. embargo. You must have a valid OrderFit account in good standing.

Companies and agencies cannot enroll on behalf of an individual creator — accounts must be held by the natural person who will create the content.

2. How payouts work

  • You earn $10 USD for each user who (a) creates an OrderFit account using your unique referral code or link, AND (b) successfully converts from a free trial to a paying subscription. Both conditions must be met.
  • A referral that signs up but never starts a trial, or starts a trial but does not convert to a paid subscription, generates no payout.
  • A referral that converts and is later refunded by Apple, charged back, or cancelled within Apple's refund window will be marked revoked and the $10 will be reversed (subtracted from your unpaid balance, or invoiced if already paid out — see "Clawback" below).
  • We process payouts on a monthly cadence via PayPal, Cash App, Chime, or Zelle (you choose in dashboard settings). The minimum payout threshold is $20; balances below that roll over to the next cycle.
  • Self-referrals — using your own code on a second account, or coordinating sign-ups with people who do not intend to use OrderFit — are fraud. They result in forfeiture of all unpaid earnings and termination from the Program.

3. Clawbacks

If a payout is reversed because the underlying subscription was refunded, charged back, or cancelled within the refund window, OrderFit may:

  • Deduct the reversed amount from your next payout, OR
  • If you have no upcoming payouts, send you an invoice for the reversed amount, payable within 30 days.

You agree we may set off any owed clawbacks against current or future earnings without further notice.

4. What you can promote — and what you can't

Allowed:

  • Posting honest reviews / demos / "what I eat in a day" videos featuring OrderFit on TikTok, Instagram, YouTube, X, Snapchat, or your own blog.
  • Sharing your referral link / code / QR code in your bio, video captions, stories, or DMs to people who asked.
  • Reposting your content to OrderFit's official channels — we may also feature your content with attribution (see Section 6).

Not allowed:

  • Spam: mass DMs to strangers, comment-spamming forums, fake accounts.
  • Misleading claims: e.g. "OrderFit is FDA-approved" (it isn't), "guaranteed weight loss," medical advice claims, or impersonating a doctor / dietitian unless you actually are one.
  • Brand-keyword paid ads: bidding on "OrderFit," "Order Fit," misspellings, or trademarked variations on Google / Apple Search Ads / Meta / TikTok Ads. We run those.
  • Incentivized signups: paying users to use your code, running giveaways with code-as-entry, or any flow where the user gets value from joining other than the OrderFit product itself — unless explicitly approved by us in writing.
  • Impersonation: creating accounts, websites, or social handles that look like official OrderFit accounts.
  • Cookie stuffing or any technical mechanism that forces a referral attribution without the user's intent.
  • Promoting OrderFit alongside content involving illegal activity, hate speech, harassment, sexually explicit material, or other content that violates the platform's community guidelines you're posting on.

Violations may result in withholding of unpaid earnings, clawback of paid earnings, and termination from the Program — at our reasonable discretion.

5. FTC disclosure

Because you receive a financial benefit when followers sign up through your code, U.S. Federal Trade Commission rules require you to clearly disclose your relationship with OrderFit on each piece of promotional content. Examples:

  • "#ad" or "#sponsored" tag on the post.
  • "I earn a commission when you use my code" in the caption.
  • The TikTok / Instagram built-in "paid partnership" toggle.

Failure to disclose is on you — OrderFit is not liable for FTC penalties resulting from your non-disclosure, but we may suspend your participation if we discover repeated non-disclosure.

6. Content & intellectual property

You own your content. OrderFit does not claim ownership of any video, photo, post, or caption you create.

You grant OrderFit a non-exclusive, worldwide, royalty-free, sublicensable license to repost, embed, feature, and re-edit your OrderFit-related public content on OrderFit's official social channels, marketing materials, app, and website, with attribution by handle. You can revoke this license for future re-use by emailing us; we'll remove on a forward basis but won't pull material that's already been baked into ad creatives or app store listings.

You agree not to use OrderFit's logos, trademarks, or app screenshots in ways that could imply OrderFit endorses content not actually approved by us.

7. Tax responsibility

You are solely responsible for any income tax, self-employment tax, sales tax, VAT, or other tax obligations on your Program earnings. OrderFit does not withhold taxes on your behalf.

If you are a U.S. person and your Program earnings in a calendar year reach the IRS reporting threshold (currently $600), we will request a completed W-9 form from you and issue a 1099-NEC after year-end. Non-U.S. creators may be asked to complete a W-8BEN. Failure to provide a valid tax form on request will pause payouts until received.

8. Privacy & what we display publicly

By completing creator onboarding, you opt in to making the following data publicly visible on OrderFit surfaces:

  • Your display name (the one you set in your profile).
  • Any social URLs you add (Instagram, TikTok, YouTube, X) — these are linked publicly.
  • Your paid-referral count — appears on the public leaderboard and in the rotating "featured creator" slot shown to new users during onboarding.

Your earnings, payout method, payout identifier (PayPal email, $cashtag, etc.), tax forms, and email address are NEVER displayed publicly. They are visible only to you and to OrderFit operations staff with a need to know (e.g. payout processing, fraud review, support tickets).

If you want to leave the Program, contact us. We will deactivate the public surfaces (your handle stops appearing on leaderboards within 24 hours) and stop accruing new payouts. We may retain transaction records for the period required by tax law (typically 7 years in the U.S.).

All other data handling — what we collect, how we use it, your rights to access/delete — is governed by the standard OrderFit Privacy Policy.

9. Termination

You can leave the Program at any time by contacting us. Pending non-revoked payouts you've already earned at the time of departure will still be processed on the next cycle (subject to Section 2 conditions).

OrderFit can suspend or terminate your participation at any time for material breach of these terms (especially the prohibited-promotion list in Section 4 and the fraud rules in Section 2). When that happens, unpaid earnings tied to the breach are forfeit; clean unpaid earnings unrelated to the breach are still paid out.

We may also wind down the Program entirely with 30 days' notice. If we do, all unpaid clean earnings are paid out within 60 days of the wind-down.

10. Changes to these terms

We may modify these Creator Program Terms by posting an updated version here and bumping the version number at the top of the page. For material changes (anything affecting payouts, prohibited-promotion list, or your data), we'll notify you in the dashboard and via email at least 30 days before the change takes effect, and ask you to re-accept. Continuing to participate after the effective date means you accept the new terms.

11. Disclaimers & limits

The Program is provided "as is." OrderFit makes no guarantee of any specific level of earnings — your results depend entirely on your content, audience, and how often you post.

To the maximum extent permitted by law, OrderFit's total liability to you under or relating to the Program is capped at the sum of payouts you actually received from us in the 12 months immediately preceding the event giving rise to the claim. We are not liable for indirect, consequential, special, or punitive damages.

12. Independent contractors

Nothing in these terms creates an employment, agency, partnership, or joint-venture relationship between you and OrderFit. You are an independent third party. You cannot bind OrderFit to any contract or commitment.

13. Governing law & disputes

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to the Program will be resolved in the state or federal courts located in Delaware, and you consent to that venue.

If any clause of these terms is found unenforceable, the remainder stays in effect.
